Vote fraud through the mail, not Mail Fraud?

I don’t know where Pikeville is, but there’s an interesting case in Frankfurt, Kentucky where the accussed bag man for politic, Lauren Glenn Turner, is also accused of vote fraud.

Turner originally was sentenced to four years in prison after being convicted of mail fraud in 2004. In the same trial, Harris was convicted of vote fraud conspiracy and sentenced to 18 months of home incarceration.

But after Harris died last June, the 6th U.S. Circuit Court of Appeals overturned Turner’s conviction and indictment, ruling that the federal mail fraud statute could not be used to prosecute vote fraud.

Um, so there you have it folks, vote fraud is not mail fraud. Even when you are the suspected bag man, funneling thousands of illegal contributions to some politician.
